When you see a company that you suspect is employing illegal aliens, simply mail them a copy of our pre-printed letters. They have our name and our return address on them. They are letters from NCFIRE, you are simply addressing the envelope and placing a stamp on it. You can never be identified as having sent it and your identity remains 100% anonymous.

By drying up the job market here, the illegal aliens will go elsewhere.

Propaganda and Fear

The following story from ABC news needs to be read carefully. The headline of the story “Michelle Obama Rouses NAACP Before Vote Condemning ‘Racist’ Elements of Tea Party” seems to be implying that she is condemning the Tea Party. In no part of her speech was this said or implied.

The charges against the Tea Party outlined below are a sad attempt to discredit Americans. Let me know when someone collects the reward from Andrew Breitbart for the alleged racist comments made to a Congressman. Baiting patriots in Washington, DC by our speaker of the house and other congressman will not be forgotten. Lies and articles like this are desperate attempts to divert us from our efforts to restore the country. 

First Lady Michelle Obama brought renewed energy to the NAACP today, delivering the keynote speech at the annual convention one day before the nation’s largest civil rights group is expected to condemn what it calls racist elements in the Tea Party movement.

The nation’s largest and oldest civil rights organization will vote on the resolution Tuesday during its annual convention in Kansas City, Mo.

In her speech, the first lady focused on the issue of childhood obesity and her “Let’s Move” initiative, but outside of her remarks, anti-Tea Party activism has been a key focus of the gathering, which conservative leaders say is driven solely by a political agenda.

Tea Party members have used “racial epithets,” have verbally abused black members of Congress and threatened them, and protestors have engaged in “explicitly racist behavior” and “displayed signs and posters intended to degrade people of color generally and President Barack Obama specifically,” according to the proposed resolution.

“We’re deeply concerned about elements that are trying to move the country back, trying to reverse progress that we’ve made,” NAACP spokeswoman Leila McDowell told ABC News. “We are asking that the law-abiding members of the Tea Party repudiate those racist elements, that they recognize the historic and present racist elements that are within the Tea Party movement.”

The National Association for the Advancement of Colored People, in coordination with 170 other groups, including labor unions, is planning a protest march in Washington, D.C., Oct. 10 as the next step in building momentum against the Tea Party.

The “One Nation” march is designed as an antithesis to the Tea Party, and it’s about “pulling America together and back to work,” McDowell said.

When Does the End Justify the Means?

“I am well aware of the toil and blood and treasure it will cost us to maintain this declaration, and support and defend these states. Yet through all the gloom I see the rays of ravishing light and glory. I can see that the end is worth all the means.

 John Adams

The above quote refers to our Declaration of Independence. In the past three weeks, I have seen two disturbing trends in the patriot movement. The first is the outright declaration by people that the federal government is not following our Constitution. To publicly state that the government is no longer bound by the rule of law leads to the second trend which is very disturbing: the federal government has been overthrown from the inside.

Although I could give multiple examples validating these assertions, there is only one that needs to be addressed to make the point. The federal government is suing the state of Arizona for simply enforcing federal law.

We have two choices for our future. If we continue on our government’s current path, we will suffer tyranny and slavery. Any infringement on our freedom is intolerable and was the only reason for the American Revolution.

The second choice will not be easy. John Adams saw it. George Washington saw it. Thomas Jefferson saw it. They made the right decision to give us a country worth dying for. I believe that the Lord blessed this country’s birth and ascension to be the greatest nation that the world has ever seen. When will you see it?

Did You Vote for Lower Taxes?

In just six months, the largest tax hikes in the history of America will take effect.  They will hit families and small businesses in three great waves on January 1, 2011:

(N.B. This version of the document contains even more tax hikes than the original version did)

First Wave: Expiration of 2001 and 2003 Tax Relief

In 2001 and 2003, the GOP Congress enacted several tax cuts for investors, small business owners, and families.  These will all expire on January 1, 2011:

Personal income tax rates will rise.  The top income tax rate will rise from 35 to 39.6 percent (this is also the rate at which two-thirds of small business profits are taxed).  The lowest rate will rise from 10 to 15 percent.  All the rates in between will also rise.  Itemized deductions and personal exemptions will again phase out, which has the same mathematical effect as higher marginal tax rates.  The full list of marginal rate hikes is below:

- The 10% bracket rises to an expanded 15%
- The 25% bracket rises to 28%
- The 28% bracket rises to 31%
- The 33% bracket rises to 36%
- The 35% bracket rises to 39.6%

Higher taxes on marriage and family.  The “marriage penalty” (narrower tax brackets for married couples) will return from the first dollar of income.  The child tax credit will be cut in half from $1000 to $500 per child.  The standard deduction will no longer be doubled for married couples relative to the single level.  The dependent care and adoption tax credits will be cut.

The return of the Death Tax.  This year, there is no death tax.  For those dying on or after January 1 2011, there is a 55 percent top death tax rate on estates over $1 million.  A person leaving behind two homes and a retirement account could easily pass along a death tax bill to their loved ones.

Higher tax rates on savers and investors.  The capital gains tax will rise from 15 percent this year to 20 percent in 2011.  The dividends tax will rise from 15 percent this year to 39.6 percent in 2011.  These rates will rise another 3.8 percent in 2013.

Second Wave: Obamacare

There are over twenty new or higher taxes in Obamacare.  Several will first go into effect on January 1, 2011.  They include:

The Tanning Tax.  This went into effect on July 1st of this year.  It imposes a new, 10% excise tax on getting a tan at a tanning salon.  There is no exemption for tanners making less than $250,000 per year.

The “Medicine Cabinet Tax”  Thanks to Obamacare, Americans will no longer be able to use health savings account (HSA), flexible spending account (FSA), or health reimbursement (HRA) pre-tax dollars to purchase non-prescription, over-the-counter medicines (except insulin).

The HSA Withdrawal Tax Hike.  This provision of Obamacare increases the additional tax on non-medical early withdrawals from an HSA from 10 to 20 percent, disadvantaging them relative to IRAs and other tax-advantaged accounts, which remain at 10 percent.

Brand Name Drug Tax.  Starting next year, there will be a multi-billion dollar tax assessment imposed on name-brand drug manufacturers.  This tax, like all excise taxes, will raise the price of medicine, hurting everyone.

Economic Substance Doctrine.  The IRS is now empowered to disallow perfectly-legal tax deductions and maneuvers merely because it judges that the deduction or action lacks “economic substance.”  This is obviously an arbitrary empowerment of IRS agents.

Employer Reporting of Health Insurance Costs on a W-2.  This will start for W-2s in the 2011 tax year.  While not a tax increase in itself, it makes it very easy for Congress to tax employer-provided healthcare benefits later.

Third Wave: The Alternative Minimum Tax and Employer Tax Hikes

When Americans prepare to file their tax returns in January of 2011, they’ll be in for a nasty surprise—the AMT won’t be held harmless, and many tax relief provisions will have expired.  These major items include:

The AMT will ensnare over 28 million families, up from 4 million last year.  According to the left-leaning Tax Policy Center, Congress’ failure to index the AMT will lead to an explosion of AMT taxpaying families—rising from 4 million last year to 28.5 million.  These families will have to calculate their tax burdens twice, and pay taxes at the higher level.  The AMT was created in 1969 to ensnare a handful of taxpayers.

Small business expensing will be slashed and 50% expensing will disappear.  Small businesses can normally expense (rather than slowly-deduct, or “depreciate”) equipment purchases up to $250,000.  This will be cut all the way down to $25,000.  Larger businesses can expense half of their purchases of equipment.  In January of 2011, all of it will have to be “depreciated.”

Taxes will be raised on all types of businesses.  There are literally scores of tax hikes on business that will take place.  The biggest is the loss of the “research and experimentation tax credit,” but there are many, many others.  Combining high marginal tax rates with the loss of this tax relief will cost jobs.

Tax Benefits for Education and Teaching Reduced.  The deduction for tuition and fees will not be available.  Tax credits for education will be limited.  Teachers will no longer be able to deduct classroom expenses.  Coverdell Education Savings Accounts will be cut.  Employer-provided educational assistance is curtailed.  The student loan interest deduction will be disallowed for hundreds of thousands of families.

Charitable Contributions from IRAs no longer allowed.  Under current law, a retired person with an IRA can contribute up to $100,000 per year directly to a charity from their IRA.  This contribution also counts toward an annual “required minimum distribution.”  This ability will no longer be there.

ACTION ALERT…Bus ride from Triangle area NC to the Glenn Beck Restoring Honor (August 28th)

Triangle Conservatives Unite Laura Long has chartered 2 buses $35.00 a seat.  Randy’s Right says this is the way to go.  You don’t to worry about parking,  dropped off close to the event and you can sleep on the way home.  Only way to travel.  We want to thank Laura Long for arranging the bus ride. Laura rocks

If you would like to take a bus ride up to the August 28th Glenn Beck event – Restoring Honor in America, please sign up and pay for your bus ticket. Each bus will have a restroom on board. We will make a non-stop trip, so please bring snacks/drinks for the morning. We will make a stop for dinner on the way home.

Expect hot weather for the day of the festival and make sure you bring water, hats, sunscreen, etc. We will be able to store signs under the bus, but nothing too large.

The bus will drop us off as close to the event as possible and will return to pick us up afterward to bring us home.

Please go ahead and purchase your ticket now so we have the money to reserve the bus.

The bus will leave from Crescent Commons in Cary off of Kildaire Farm Road (where the Harris Teeter, Walmart and TGIF are… there is a huge parking lot there and we can park our cars in the very back of the parking lot. Just look for the bus(ses).

Tea Party Convention in Las Vegas

DECISION TO DELAY THE CONVENTION UNTIL OCTOBER

Hello everyone –

This week, there were several meetings of the Executive Planning Committee for the convention.  We concluded it would more advantageous to hold the convention in the middle of October just prior to the November elections.

We had to have a deep and serious discussion for three days as we delved into every aspect of this matter before pushing it back and catering to the wishes of so many who wanted to attend.  

Like most of you, we are new to this and are not professional event planners.  Unlike many other national organizations involved in this movement, we don’t have huge budgets for PR and Marketing departments.  Everyone associated with the organizing of the first convention and this convention are just ordinary people like you trying to save our country in any way we can.

As stated before, we are new and are trying to include as many people as possible for this Unity convention.  After all, it is for the people!  This time for the West Coast…giving attendees facts, education, opportunities to meet people they would never be able to meet otherwise and most importantly feeding the hunger these people need to be around like-minded people.  

This was not a spur of the moment decision contrary to anyone’s opinion or thoughts.  It was agonizing going over the facts and figures of why we must do this change and still do an amazing service to our members and future members. 

Those who wish to be a part of this endeavor, we welcome you with open arms.  

Those who are not going to wish us well and only want to cause division or strife, are not a part of the solution.  That is a message in itself.  Our intent is to gain the greatest momentum and the greatest delivery to the greatest amount of patriots.   Nothing more, nothing less.

The National groups in this country must come to our aid and to the aid of the country with the acknowledgment  our country is in a mess and listen to the people as the Congress and President obviously are not.  We have an obligation we have undertaken to partner in the reestablishment of the rule over these circumstances and situations the economy and the government has put us in.  We are doing our best as stewards of these duties and our capacities are dictated by the people and the economy.  

We were so excited about the tremendous success of the first convention, we jumped into this second convention without considering the timing.  The heat in Las Vegas in July is keeping many who would like to participate from attending. We have also received numerous emails from people who were forced to decide between family vacations and attending the convention.

We have also gained valuable access to new Tea Party Groups in the United States who have contacted us and we have contacted others, therefore, the time delay will allow them  the valuable and necessary time they need to be a part of this amazing event.  The timing was wrong on our part in the July dates. The nay-sayers will always ridicule or tear down others, the true patriots — like our military, help the fallen up by extending a hand.  Those patriots are the backbone of this country…who carry the American Flag proudly we might add.

We too, are a result of the present situation the government has put us in as a residue of what the entire country is feeling.  Therefore, because of TPN being in the exact same grouping as the rest of the nation, we feel we better communicate and understand the hardships and the struggles the people of our great nation are feeling.  

In the center of this grand anthem of acknowledgment the towering truth is…we will be in one of the hardest hit cities in America to help bolster their esteem, and economy in October!  

Thank you again for your understanding and support. The momentum we gain from holding the convention in October as we head into the November elections, we feel will be worth all of the sacrifices and inconveniences.

American Patriots Gather in Greensboro, NC to Demand That Their Government Abide by the Constitution

This August 14th, freedom-loving Americans from all walks of life will gather in Greensboro North Carolina to peacefully demand that their government abide by the U.S. Constitution and the Bill of Rights. The Restore The Constitution rally [http://www.nps.gov/guco/planyourvisit/maps.htm ] will assemble at Guilford Courthouse Battleground Park to hold a peaceful demonstration with a single, simple message:

RESTORE THE CONSTITUTION – NOW!

According to the Restore The Constitution organizers:

“We want to remind Americans that they have a basic human right to keep and bear arms – both for self-defense and to preserve individual freedom – that is not only enshrined in the Bill of Rights, but is protected only by Americans’ willingness to actually exercise that right. Just as is true with free speech, freedom of assembly, and every other right guaranteed by the Constitution – if you don’t insist on your Constitutional freedoms by exercising them in public, you will lose them.”

In 1788, with the ratification vote by New Hampshire, the Constitution was adopted as the supreme law of the land. The Bill of Rights, as ratified by Virginia in late 1791, placed additional essential limitations on the powers of the government created by the Constitution. Together, the Constitution and the Bill of Rights set forth very specific limited powers for the Federal government, while also providing crucial protections for both individuals and the states from attempts by the Federal government to step outside those limits.

Over the years, as the nation grew and prospered, American citizens became lax in their vigilance against the slow and continuous encroachment of government into their private lives and affairs. Over the past 100 years, all three branches of the Federal government have stepped far beyond the clearly-articulated and mandatory boundaries set by the Constitution and the Bill of Rights.

With the actions taken in recent years by power-hungry Republican and Democratic politicians (examples include the bank bailouts in TARP, the automobile manufacturers’ bailout, and the recent healthcare mandate) and activist Federal judges (example: the Kelo decision), more and more Americans have had enough. They have awakened, and they notice with increasing dismay as leading politicians in both the White House and Congress disregard and even openly mock the supreme law of the land. Today’s patriots also recognize that when the Constitution and the Bill of Rights are interpreted consistently to justify the expansion of government and to mean whatever those in power say it means, we are headed towards a return to life as subjects under the thumb of tyrants.

The American citizens who gather this August 14th at the Restore The Constitution rally will openly and safely carry their firearms as they peacefully assemble  to proclaim their grievances and demand redress from their servant politicians and officials. In short, every one of the participants in the Restore The Constitution event will each be exercising God-given human rights explicitly acknowledged by the U.S. Constitution and the Bill of Rights. As the Restore The Constitution organizers put it:

“Can you imagine what the Founders would have said if they knew, after all of the blood and the pain of the recent revolution, that to enter the Federal governmental district created by the Constitution, American citizens would have to completely disarm themselves while petitioning their servants in government? The Founders would not have tolerated such arrogance by public officials, and they would have asked today’s Americans some pretty tough questions as to why we accept such behavior.”

Undoubtedly, there will be those in the media and government who will mischaracterize these loyal Americans as racist “haters,” bigots, right-wing extremists, domestic terrorists, and similar epithets. Those slanderous accusations are completely false, and the men and women who will gather on August 14th are nothing of the sort. The participants in the Restore The Constitution event are patriotic, everyday Americans who simply insist that their government respect the rights guaranteed by and obey the limitations imposed by the supreme law of the land – the United States Constitution and the Bill of Rights.

Rules of (non) Engagement

Pistol loaded, openly carried. Rifle unloaded, slung to rear. Bandoleer of magazines containing ammo. All in accordance with rules below. Please note that guidelines below are subject to final coordination with the Department of the Interior:

Participants and attendees are expected to know and abide by all applicable state and federal firearms laws. None of the information provided below is legal advice, and no attorney-client relationship is created by reading or relying upon this information. If you have questions, then you are expected to know the applicable state and federal firearms laws before attending the event. Anyone prohibited from possessing a firearm by state or federal law may not possess a firearm at this event.Participants and attendees may not bring any firearm prohibited by state or federal law.

1. ALL rifles and shotguns carried by participants at this event are to be unloaded (chamber empty, no magazine inserted, no ammo inside the rifle or shotgun, no ammo touching the rifle or shotgun whatsoever) and slung to the rear or to the side, away from the hands.Although the law does allow for carry of some types of loaded rifles and some types of shotguns in some circumstances, our guidelines are simpler and more strict due to the relative novelty of this event and the high level of attention it is likely to receive from law enforcement, government, and the media.2. While we do ask that your rifles and shotguns be unloaded, you are perfectly welcome to carry ammunition and loaded magazines on your person if you so choose, so long as no magazines are actually inserted into rifles and so long as you are not prohibited from owning a firearm.3. Open carry of a loaded pistol is allowed.

Concealed carry of a pistol is allowed for those with a valid North Carolina concealed handgun permit or a concealed handgun permit from a state for which North Carolina allows concealed carry in North Carolina (See the North Carolina Department of Justice website for a list of those states at www.ncdoj.com; we do not vouch for the authenticity or accuracy of that list).Anyone carrying their pistol openly or concealed cannot have in it a magazine capable of holding over 20 rounds and cannot have a pistol designed to accept a silencer or suppressorParticipants and attendees are required to keep all pistols holstered. Participants and attendees are required to keep all rifles/shotguns slung over their shoulder, muzzle-down, unloaded, with the safety on, and with no magazine inserted. Brandishing of firearms is prohibited by North Carolina law. It is unlawful for any person to (a) point, hold, or brandish any firearm in such a manner as to reasonably induce fear in the mind of another or (b) hold a firearm in a public place in such a manner as to reasonably induce fear in the mind of another being shot or injured. Do not engage in any horseplay, demonstration of firing positions, or exchange of or other handling of firearms at Guilford Courthouse Battleground Park, or any other location or vehicle of transportation associated with this event.By federal law, firearms are prohibited in federal facilities (defined by federal law as a building or part thereof owned or leased by the federal government, where federal employees are regularly present for the purpose of performing their official duties).Do not transport a loaded rifle or shotgun in any vehicle on any public street, road, or highway during this event.Participants and attendees are not to consume, possess, or be under the influence of alcohol or illegal substances at this event.

Again, these guidelines are, as of now, subject to final coordination with the Department of the Interior.

“Now OUR PERSONAL
GUIDELINES of Conduct”

1.

God bless these national park service rangers.  they have put so much effort into making this event run well that it is as much their event as it is ours.  seems there have already been events preceeding this one up in the blue ridge parkway (the third national park in the state) involving open carry and long arms.  they have already had their discussion with the local l.e. agencies about this event and have made it clear that on their side of the park boundry, it’s their world and they rule.  make no mistake, there will be officers from the local l.e. in the park at this rally, just as there were at gravelly point.  as long as we behave and make sure the rangers don’t have any problems, we won’t have any problems, and we all get to go home.  if we make them have a bad day, then we will have a bad day.  test their patience only if you’re interested in having a little late supper at the local hospitality center downtown run by local l.e. guys. they are open all night.

to accomodate a large number of visitors to the park for special events, some larger that ours, the park rangers close down the loop road thru the park and allow only event attendees and bicycle traffic to enter.  this makes available extra parking along the roadside.  there will be at least one very sharp and official looking park ranger asking everybody that drives up to the park entrance, “are you here to attend the rally?”, and you will say, “yes sir.”  then you will be permitted to enter and park along the roadside.  it’s just that easy.  see note 1 above.

on your way to the park, say the word “obama” several hundred times till you’re good and tired of saying it and hearing it.  in this way you won’t feel like saying or hearing it once inside the park.  in fact, it would be best, if it were to be reported by the press, that not one mention of that name was made during the entire rally.  afterall, he is just but one of the many that have trampled on our constitutional rights and used abusive political power. deny them all individual recognition because to them, that is achievement of their goals.  “it’s the words that we don’t say, that sometimes say the most”.  think of note 1 above.

just like at fort hunt, there will be an official check-in table.  it will be located at the pathway leading to the General Greene monument and aphitheater area, the rally point.  That pathway is near the entrance to the park loop road on the right.  (see the pictures).  after you park and take a picture of where your are with your cell phone, proceed directly to the check-in desk. there will be rally marshalls along the loop road to assist you in properly slinging your long arms and directing you towards the check-in table.  there may be park rangers along the way, just to make sure you don’t get lost following the road.  see note 1 above.

the rally point is in 25% shade at 13:00 and this increases in the afternoon.  the amphitheater is completly shaded all afternoon.  the General Green monument will still be in full sun when the park gates close at 17:00.  Shade is provided mostly by tall oak trees that surround the rally point on all sides.  (see pictures).  there are no tables or benches in this area, so if you need a chair or two, bring them.  stay off the monument.  General Greene is the only one authorised to ride the horse.  this section of the state is notorious for heat and humidity in august. we will have some (hopefully cold) bottled water available free for the asking, just in case you forgot to bring your own. there will also be an ems vehicle near our location.  and if you like bugs, we’ve got them.  the only park animals you’re allowed to personally dispatch, at will.  mosquitoes are fond of the shade and the circle flies are fond of the podium area.  nothing you haven’t had to deal with in the past, so you know what works best for you.  do not make the etiquitte faux pau of wearing black bdu’s to this event as they attract an excessive amount of media attention.  this always makes those around you uncomfortable and occasionally irritable, although they are not permitted to cause you bodily harm.  here.  now.  this time.  and yes, see note 1 above.

our most gracious host, the park rangers, are permitting us four port-a-johns, to be located in the shade, near, but adequately away from, both the rally point and the check-in desk.  regular restroom facilities are located back across the road from the entrance at the visitor’s center.  there is much inside to see and you should stop by either before or after the rally.  if during the rally, it should happen that you really, really need to make a quik visit to the visitor’s center, the proper procedure is to ask a marshall to either sholder your gear or assist you in transfering your gear to  a friend not wearing a park ranger badge. there are no firearms permitted in the visitor’s center.  that road is not national park service property. once on that road, you are fair game for the local l.e guys and passing motorists.  think “open season” and they have no bag limit.  if the marshalls were allowed tasers (which they are not), then attempting to cross the road with your firearms would guarantee the most gleeful demonstration of their skills and abilities.   see note 1 above.  did you read note 1 above?  it’s real important.

if all goes well, the event will wrap up at 16:00 sharp.  this will give me time to go behind all of you and make sure we haven’t left a mess for the park rangers, before they close the gates at 17:00.  in the event the sky should open up and drop a big one on us, hiding under the oak trees till it’s over isn’t an option.     the park rangers will direct us to stop and vacate the area or whatever they deem necessary.  there probably is a multi-page form that would have to be filled out when park visitors get vaporized  by lightning.  there is no rain date for this event, but there will be another.

the press and media will eventually find us at this rally.  they will walk freely amoung us, while you’re doing your best to listen to the speakers, and sometimes ask you the most amazing things.  an area for interviewing will be maintained near the General Greene monument.  great place for pictures, too.  (don’t forget to include your new found buddies in the park service when it comes to photo ops).  most of the press and media, even if they read the prepared  press handouts, will for go their understanding of what it all really means, by getting you to tell the story, and then spinning it into something unrecognizable.  if you have a lot to say, and they seem to be encourageing you to talk, go to the interviewing area.  at the gravelly point rally, it was the russian new service that most nearly got the story straight.  believe it or not. if you don’t feel like talking, you don’t have to.  they can’t make you, and i won’t tell you what to say.  but you know, this “rule of law” and “it’s in the constitution” stuff is so simple, even a caveman can understand it.  but there are some that don’t get it and some that won’t get it.  that’s why we are having these rallies.  tom jefferson could explain it better, but if this republic is going to remain a government of “we the people”, then the constitution is the owners manual on how to keep it that way.

Alamance Sheriff Continues to be Harassed by US Dept of Justice for Their 287g Program

Sheriff Terry Johnson is not being harassed by the citizens of Alamance county that voted him into office.  He has been continually harassed over the last 2 years by outside organizations.  We all need to support the citzens of Alamance county and Sheriff Johnson who chose to have this legal program that is a Federal program.  This is a fracking joke of harassment by moonbats.  Randy’s Right went to Alamance county last year wiht the citzens of this county to support Sheriff Jonson and the people of Alamance.  Here’s a few photos I snapped of the citzens of Alamnce County supporting their Sheriff

Allegations of “discriminatory policing and unconstitutional searches and seizures” by the Alamance County Sheriff’s Office have prompted an investigation by the U.S. Department of Justice, according to a letter sent to the sheriff’s office. The letter was originally sent to County Attorney Clyde Albright who forwarded the letter to the sheriff’s office.

Alejandro Miyar, spokesperson for the U.S. Department of Justice, said the department could not comment on an open investigation.

“The case is open and ongoing,” Miyar said. “And the Alamance County Sheriff’s Office is cooperating.”

The allegations of discriminatory policing were against Latinos, he said.

The letter, dated June 2, was sent by Judy Preston, the acting chief of the Civil Rights Division of the U.S. Department of Justice. According to a press release from the sheriff’s office spokesperson Randy Jones, the letter “is silent as to whether the allegations were made by a person arrested by the deputies, otherwise confined in the detention center or made by an organization.”

The files and detention center logs will be available to the justice department, Jones wrote, as they have been available to “local parties interested in these matters.”

“We have no issues, no concerns about anything done wrong,” Jones said. “They’ve asked for our cooperation with whatever they want to do, and we have assured them we will cooperate.”

In recent years various groups have questioned Sheriff Terry Johnson’s enforcement of the 287(g) section of the federal immigration law. This section of the law gives local law enforcement officers the power to arrest and detain people who have illegally entered the United States.

The ACLU

In 2009, the American Civil Liberties Union of North Carolina requested thousands of public records regarding 287(g). In Jones’ press release he wrote the ACLU reviewed the documents and “did not reveal any wrongdoing on the part of the Alamance County Sheriff’s Office.”

Katherine Parker, legal director for the state branch of the ACLU, said that is not true.

“I don’t know why they are spreading this falsehood,” Parker said. “We never told the sheriff we were not concerned. I don’t know where their rationale is for this.”

The ACLU, Parker said, has expressed concerns of racial profiling and checkpoints in predominantly Latino areas.

“We do have these concerns, and we have heard complaints,” she said. “The records we have been reviewing suggest (the arrests) are disproportionately Latino.”

The majority of the arrests are for no operator’s license or driving while license revoked, she said.

“It begs the question, ‘Why are they being stopped in the first place?’” Parker said. “We have not drawn any final conclusions, and we did not file the complaint, but we support this investigation.”

But Jones and Alamance County Commissioner Linda Massey said when Parker came to the Sheriff’s office in April 2009, she said the sheriff’s office was not a fault.

“After explaining our traffic stop reporting system,” Jones wrote in an e-mail. “She remarked our system could be an example for everyone in the state to follow.”

Massey recalls Parker telling the sheriff it was other agencies including the Highway State Patrol who “were arresting most of the Hispanics.”

Parker said she was told to come alone to the sheriff’s office on April 22 to “review samples and examples of the documents in order to narrow (the) document request.”

In an e-mail from Albright to Parker, he writes she needed to come alone in order “to meet the requirements of protecting personal and private information.”

In the meeting, Parker said, she did mention other agencies but “reiterated that (the ACLU) had received complaints from Alamance.”

“They required me to come to that meeting alone and now I know why,” Parker said. “It was so they could clearly misrepresent me. And it doesn’t matter if the ACLU has concerns, which we do, but the Department of Justice clearly has concerns.”


Fairness Alamance

Another group closer to home has also raised concerns with the sheriff’s office. Fairness Alamance has disagreed occasionally with the sheriff’s enforcement of the immigration law.

Fairness Alamance Communications Chair David Blair joined the group in 2009 and said the group has served a number of roles in the community, including police watchdog.

“We’ve monitored the Alamance County Sheriff’s Office, and we’ve suggested policy changes to the Alamance County Board of Commissioners,” Blair said.

Fairness Alamance did submit complaints last winter, but Blair said he believed they were to the immigration department and not the justice department. Regardless, he said, Fairness Alamance does support the investigation.

“I think it is a good thing and overdue,” Blair said. “What I would like to see happen and like to see this investigation (contribute) to is an open, honest and accountable enforcement of 287(g) in Alamance County.”

Sheriff’s Supporters

Sheriff Johnson is not without his own supporters. He was first elected in 2002 and is currently running for reelection. Johnson spoke at the third Alamance County Tea Party held June 19, and he was introduced by Rep. Howard Coble, R-NC, as “the best sheriff in the country.” The crowd erupted in applause.

“If the federal government doesn’t want me to enforce the laws,” Johnson said during his speech, “then get them off the books.”

Alamance County Commissioner Tim Sutton called the justice department’s investigation “pure harassment.”

“They are so pro-Latino, so pro-immigrant,” Sutton said. “They refuse to admit we have an illegal immigration crisis. We are not breaking the law. We have a good sheriff.”

The people who support the investigation are narrow-minded, he said. When an individual feels compassion for a particular group but can’t “stand to hear a negative word against them,” he said it was then time to get out of the debate.

It is “Roselle and cohorts,” Sutton continued, “who think we have to turn a blind eye if the person is illegal.”

Laura Roselle, an Elon University professor of political science, conducted her own study of traffic data in 2009 using state data. When Sheriff Johnson announced in February 2009 that the sheriff’s office had made traffic stops on 494 Hispanic drivers from 2004 to 2008, Roselle investigated the claim. She discovered there were actually 1,344 during the same time period, 850 more than Johnson originally reported. The sheriff’s office has claimed the difference was the result of software complications.

Conservatives gather for third TEA Party

Some came donned in red, white and blue. Others wore the bright yellow shirts that read “don’t tread on me.” Regardless of what they wore, upwards of 500 people battled the 90-degree weather for the third Alamance County TEA Party.

The TEA Party members met 10 a.m. Saturday, June 19 at Holly Hill Mall. A variety of politicians, religious figures and musicians took their turn reiterating the major concerns of the conservative group: to protest government waste and higher spending.

Flags and homemade signs that read “Obama is a socialist” and “there is a Marxist in the white house” were scattered among the crowd.

“I came here to support my rights,” Burlington resident Elaine Jones said. “Or what’s left of them.”

The start of the government’s downhill track, Alamance County Sheriff Terry Johnson said, was when prayer was taken out of school.

“If we don’t stand up and put the right people in the office we are going to be worse than behind the Iron Curtain,” he said.

Organizer Steve Carter has helped with all three of Alamance County’s TEA parties. The principles the TEA Party stands for were a “kindred spirit” for Carter.

“(The federal government) is a train wreck,” he said. “The federal budget is out of control and all the federal government can do is figure out to spend more money and raise taxes to pay for it.”

Snow Camp residents Anthony and Joyce Jones sat in the front row during the speeches, each holding signs protesting illegal immigration and Congress.

“Our country has one more chance to turn it around,” Joyce Jones said. “And if we don’t take that chance, who knows how many freedoms we are going to lose.”

Rob Sharpe, candidate for Alamance County District Attorney, told listeners the federal government was smarter than them and the government knew what was best for the people. When he said Gov. Bev Perdue knew what is best for Alamance County the crowd erupted in boos.

The current state of the government “couldn’t be in worse shape,” Alamance County Commissioner Bill Lashley said.

“Apparently Obama doesn’t have a clue as far as economics and there is no way someone could be that stupid,” he said. “It could not be done by accident, it’s got to be done on purpose. It’s socialism as fast as they can take us.”

Reggie Saddler, former member of the Platters now gospel singer, used song and scripture to drive home his political message.

“The Bible, constitution and declaration of independence is my foundation,” he said. “And when you keep chipping away at the foundation, eventually it’s going to fall.”

Saddler, along with other black speakers, told listeners the TEA Party movement was not racist or affiliated with any party.

While the movement was conservative, Carter said, it was nonpartisan and he invited a variety of speakers across the political spectrum to speak at the rally. Only Republicans and Libertarians accepted, he said.

The number of attendees has increased with each rally, Carter said, and it means, “more people are concerned about what (the) government does.”

“Our main goal is to let voters know their is an alternative,” he said. “Let them know they have a right to vote and they can do something about their concerns.”

Miyar said there is no speculation as to when the investigation will conclude.
